General Terms and Conditions of Sale

1. introduction

These general terms and conditions regulate the contractual relations between BrandsFirst, based in Portugal, and the customer, relating to the purchase of products through the site www.brandsfirst.pt. By placing an order, the customer fully accepts these conditions.

2. Ordering

Orders are placed exclusively via the website. Order confirmation is sent by email. BrandsFirst reserves the right to refuse orders in cases of unavailability of stock, pricing errors or other exceptional circumstances.

3. Prices and payments

All prices indicated on the site include VAT at the legal rate in force. The payment methods available include credit card and bank transfer, or others that may be indicated during the purchase process. Payments are made in euros (€). BrandsFirst guarantees the security of transactions through encrypted systems.

4. Delivery

Products are delivered nationally (mainland Portugal and the islands) and internationally, according to the options presented on the website. The delivery time is indicated during the purchase process and depends on email confirmation. BrandsFirst is not responsible for delivery delays resulting from causes beyond its control, such as strikes, adverse weather conditions or other events of force majeure.

4.1 Store survey

If the customer chooses in-store pick-up, they will be notified by email when the order is available. The customer must present the order number and an identification document at the time of collection.

5. Cancellations and Returns

The customer has the right to cancel the order before dispatch and should contact BrandsFirst customer support. After receiving the products, the customer has 14 days to return them, in accordance with consumer protection legislation (Right of Free Resolution). Products must be returned in perfect condition, in their original packaging, without signs of use, and accompanied by the purchase invoice.

5.1 Returns procedure

To start the returns process, the customer must contact BrandsFirst customer support via the email address provided on the website. Returns must be properly packaged to avoid damage during transport. The customer is responsible for the return costs, except in cases where the return is due to a BrandsFirst error or product defect.

6. Warranty

Products sold by BrandsFirst benefit from the legal guarantee of conformity and the guarantee against hidden defects, under the terms of the Portuguese Civil Code. The customer must notify BrandsFirst of any defect or non-conformity of the product within a reasonable time of its discovery. The customer has the right to request repair, replacement, price reduction or cancellation of the contract, depending on the case.

7. Personal Data

BrandsFirst undertakes to protect the customer's personal data in accordance with the General Data Protection Regulation (GDPR) and applicable national legislation. The data collected during the purchase process will be used exclusively for processing orders and communicating with the customer. The customer has the right to access, rectify or request the deletion of their personal data by contacting BrandsFirst.

8. Dispute resolution

In the event of a dispute, the customer has the right to appeal to the National Consumer Conflict Information and Arbitration Centre (CNIACC) or another competent Consumer Conflict Arbitration Centre. Alternatively, the customer may opt for the Portuguese courts to resolve conflicts. These general conditions are governed by Portuguese law.

9. Applicable legislation

This contract is governed by Portuguese law. For all matters not provided for in these general conditions, the provisions of Portuguese law shall apply.

10. Changes to the Terms and Conditions

BrandsFirst reserves the right to modify these general conditions at any time. Changes will be published on the website and apply to purchases made after the date of publication.
